Terms of Service

These Terms of Service ("Terms") govern your access to and use of Privatly ("we," "our," or "us"), including our website, application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Privatly Is

Privatly is an AI-assisted tool that helps you generate privacy policy documents based on information you provide about your business, either through a manual questionnaire or an automated scan of your website. The Service produces draft documents intended to help you communicate your data practices to your own users — it does not provide legal advice, and using it does not create an attorney-client relationship of any kind.

2. Not Legal Advice

Documents generated by the Service are produced by an AI system based on the information you supply and, where applicable, an automated scan of your website. They are a starting point, not a substitute for review by a qualified attorney licensed in your jurisdiction. You are solely responsible for reviewing, verifying, and — where appropriate — having generated documents reviewed by legal counsel before publishing or relying on them. We make no guarantee that any generated document satisfies the legal requirements applicable to your business, and we expressly disclaim any warranty of legal compliance, accuracy, or fitness for a particular purpose. This is presented to you again, and you must affirmatively acknowledge it, before each document generation.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account and keep it up to date. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.

4. Subscriptions and Billing

Certain features of the Service require a paid subscription. Subscriptions are billed in advance on a recurring basis (monthly or annual, as selected at checkout) through our payment processor, Stripe. By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel.

  • You may cancel your subscription at any time through your account's billing management page. Cancellation takes effect at the end of your current billing period; you retain access to paid features until then.
  • Fees are non-refundable except where required by law or at our discretion.
  • We may change our pricing prospectively. We will provide reasonable notice of price changes before they apply to your next billing cycle.
  • Free-tier usage limits, and the number of document generations included in each paid tier, are described on our Pricing page and may be updated from time to time.

5. Acceptable Use

You agree not to:

  • Use the Service to generate documents containing information you know to be false, with intent to mislead the people who will read them
  • Attempt to circumvent usage limits, paywalls, or access controls
  • Reverse engineer, scrape, or use automated means to access the Service beyond normal use, except as permitted by applicable law
  • Use the Service to violate any applicable law or the rights of any third party
  • Interfere with or disrupt the integrity or performance of the Service
  • Resell or redistribute access to the Service without our written consent

We may suspend or terminate accounts that violate these Terms.

6. Ownership

As between you and us, you own the documents generated for your business through the Service, and you are free to use, publish, and modify them for your own purposes. We retain all rights to the Service itself — including the underlying software, website, scanning technology, and prompts used to generate documents. We do not claim ownership of the business information you submit, but you grant us a license to process that information (including sending it to our AI and infrastructure providers, as described in our Privacy Policy) solely to provide the Service to you.

7. Disclaimers

THE SERVICE AND ANY DOCUMENTS IT GENERATES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR LEGAL COMPLIANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIVATLY AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE OR ANY DOCUMENT IT GENERATES — INCLUDING, WITHOUT LIMITATION, ANY REGULATORY FINE, LEGAL CLAIM, OR ENFORCEMENT ACTION RELATED TO A GENERATED DOCUMENT'S CONTENT OR ACCURACY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, or discontinue the Service (or any part of it) at our discretion, with reasonable notice where practicable. Upon termination, your right to use the Service ends, though provisions of these Terms that by their nature should survive (including Sections 2, 6, 7, 8, and 10) will continue to apply.

10. Governing Law and Disputes

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the courts with jurisdiction over such disputes, and you consent to that jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Effective Date" above and, where required by law, by more prominent notice. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
